Welcome to KejaMarket. By accessing or using our platform at kejamarket.co.ke, you agree to be bound by these Terms & Conditions. Please read them carefully before using the service.

1. About KejaMarket

KejaMarket is an online marketplace connecting tenants with landlords and property agencies across Kenya. We provide a platform for listing, discovering, and inquiring about rental properties. KejaMarket is not a real estate agent or property manager — we are a technology platform only.

2. User Accounts

You must be at least 18 years old to create an account
You are responsible for maintaining the confidentiality of your login credentials
You must provide accurate, truthful information when registering
One person may not operate multiple accounts for deceptive purposes
We reserve the right to suspend or terminate accounts that violate these terms

3. Landlord & Listing Rules

Landlords and agencies posting listings on KejaMarket agree to:

Only list properties they own or are legally authorised to let
Provide accurate descriptions, prices, photos and location information
Update listing availability promptly when a property is taken or vacated
Not post fraudulent, duplicate, or misleading listings
Not charge tenants viewing fees, registration fees, or finder's fees through KejaMarket
Comply with Kenya's Landlord and Tenant Act and all applicable rental laws

⚠️ Fraudulent listings will result in immediate account ban and may be reported to relevant authorities.

4. Tenant Rules

Contact landlords only for genuine rental inquiries
Do not share or misuse landlord contact details obtained through KejaMarket
Verify property details in person before making any payments to landlords
Do not make any direct payments to KejaMarket unless purchasing a platform service (e.g. WhatsApp alerts, listing boost)

5. Payments & Fees

Listing a property is free for all landlords
Optional paid features include: Top Ad boosts, Verified Landlord badge, WhatsApp/SMS rental alerts
All payments are processed via Safaricom M-Pesa Lipa Na M-Pesa
Payments are non-refundable once a service has been activated
KejaMarket is not responsible for any rent payments made directly between tenants and landlords

6. Prohibited Content

You may not post or transmit content that is:

False, misleading, or fraudulent
Discriminatory based on race, gender, religion, disability, or ethnicity
Sexually explicit, violent, or otherwise offensive
In violation of any Kenyan law
Spam, phishing, or designed to harvest user data

7. Disclaimer of Liability

KejaMarket provides the platform "as is" without warranties. We do not:

Guarantee the accuracy of any listing information
Verify the legal ownership of listed properties (beyond our verification badge process)
Accept liability for disputes between tenants and landlords
Accept liability for losses arising from fraudulent listings

Users transact with landlords at their own risk. Always verify properties in person before paying any deposits.

8. Intellectual Property

All content on KejaMarket — including the brand name, logo, code, design, and data — is owned by KejaMarket. You may not copy, reproduce, or resell any part of the platform without written permission.

By uploading photos to KejaMarket, you grant us a non-exclusive license to display those photos on our platform and marketing materials.

9. Governing Law

These Terms are governed by the laws of the Republic of Kenya. Any disputes shall be resolved in Kenyan courts.

10. Changes to Terms

We may update these Terms at any time. Continued use of the platform after changes constitutes acceptance. We will notify registered users via SMS for significant changes.
